Privacy policy

How Asset Conveyancing collects, uses, discloses and protects personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

This Privacy Policy explains how Asset Conveyancing collects, uses, discloses and protects personal information. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

Last updated 13 October 2026

1. Who we are

Asset Conveyancing (trading as Asset Conveyancing Services) is a conveyancing practice with its head office at Level 2, 300 Flinders St, Adelaide SA 5000, and virtual offices in Victoria, New South Wales and Western Australia. We act on property transactions in South Australia, Victoria, New South Wales, Queensland, Western Australia and Tasmania. In this policy, “we”, “us” and “our” mean Asset Conveyancing.

2. Protect yourself from bank detail scams

We will never change our bank details by email. If you receive an email, text or message that appears to come from us and gives new or changed bank details, do not transfer any money. Call us on (08) 8232 8446, using the number on this website rather than any number in the message, and verify the details with us before you pay.

Property transactions are a common target for email compromise scams, where criminals intercept or imitate emails to redirect deposit or settlement funds. The same risk applies in reverse, so before we pay sale proceeds or other funds to you, we may call you to confirm your account details. Money transferred to a scammer’s account is often impossible to recover.

3. What personal information do we collect?

We collect the personal information we need to act on your property or business transaction. Depending on the matter, this may include:

  • Identity information, such as your name, date of birth and signature
  • Contact information, such as your address, email address and phone numbers
  • Property and transaction details, such as the property address and title, the contract, the purchase price, ownership structure, deposit, conditions and settlement arrangements
  • Financial and bank details needed for settlement, such as account details for paying or receiving funds and details of your lender and loan
  • Identity verification documents, such as a passport, driver licence or other identity documents, which we must sight and keep to verify your identity under the Model Participation Rules for electronic conveyancing
  • Tax and residency information where relevant to the transaction, such as foreign resident status or a clearance certificate

We do not usually collect sensitive information. If a matter requires it (for example, information connected with a family law property settlement or a deceased estate), we collect it only with your consent or where the law permits. You can deal with us anonymously or under a pseudonym for a general enquiry, but we cannot act on a transaction without identifying you.

4. How do we collect personal information?

We collect most personal information directly from you, and some from other people involved in your transaction. Sources include:

  • forms you complete, including the enquiry form on our website
  • email, phone calls and meetings with you
  • real estate agents, finance and mortgage brokers, and lenders
  • the representative acting for the other party to the transaction
  • title, council and other government searches, and search providers

If you give us personal information about another person, such as a co-purchaser, please make sure they know you have done so and that they can read this policy.

5. Why do we use your personal information?

We use personal information to provide our services and to meet our legal obligations. In particular, we use it to:

  • provide conveyancing, property law and business law services, including preparing and reviewing contracts and documents
  • verify your identity and your authority to deal with the property
  • prepare for and complete electronic settlement through PEXA
  • lodge documents with land registries and revenue offices
  • respond to enquiries, give quotes and communicate with you about your matter
  • comply with the law, including conveyancing, tax and record keeping requirements

6. Who do we disclose personal information to?

We disclose personal information only as needed to complete your transaction, run our practice or comply with the law. Recipients may include:

  • PEXA, the electronic lodgment network operator used for settlement
  • land titles offices and land registries in each state
  • state revenue offices, for stamp duty and related assessments
  • councils, water authorities and search providers
  • your lender and the other party’s lender
  • the representative acting for the other party
  • real estate agents involved in the transaction
  • the Australian Taxation Office, including under the foreign resident capital gains withholding rules
  • our professional indemnity insurers and professional advisers
  • IT, software, cloud storage and email service providers who support our practice

We may also disclose personal information where you consent, or where we are required or authorised by law, such as under a court order or to a regulator. We do not sell personal information.

7. Is personal information sent overseas?

Some of our cloud, software and email providers may store or process data outside Australia. Where this happens, we take reasonable steps to ensure those providers handle personal information in a way consistent with the APPs. We do not otherwise disclose personal information overseas unless it is needed for your matter, for example when we correspond with a client or adviser located overseas.

8. How does our website handle your information?

Our website collects information you submit through the enquiry form and limited information about how visitors use the site.

Contact form

When you submit the contact or quote form, the details you enter are stored in our website and emailed to us so we can respond. Please do not include bank account details or identity documents in the form.

Cookies

Cookies are small files stored by your browser. We use them to make the site work and to measure how it is used. You can block or delete cookies in your browser settings, although some features may not work properly if you do.

Google Analytics 4

We use Google Analytics 4 to understand how visitors find and use our website, such as pages viewed, approximate location, device and browser type. Google processes this data on our behalf. You can prevent Google Analytics from collecting your data by installing the Google Analytics opt-out browser add-on.

Microsoft Clarity

We use Microsoft Clarity to see how visitors interact with our pages through session recordings and heatmaps, which show clicks, scrolling and mouse movement. We use this to find and fix problems with the site. Sensitive fields, including form inputs, are masked so their contents are not recorded.

Embedded content

Some pages may include embedded content from other websites, such as maps or videos. Embedded content behaves as if you had visited the other website, which may collect data about you, use cookies and track your interaction under its own privacy policy.

9. Do we send direct marketing?

We may occasionally send you information about our services or property updates. We do this in line with the Spam Act 2003 (Cth) and the APPs. Every marketing email includes a way to unsubscribe, and you can opt out at any time by contacting us. Opting out will not affect communications about a matter we are acting on.

10. How do we protect and retain your information?

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, change or disclosure. These steps include access controls, secure conveyancing software, password protection and restricting access to staff who need the information for their work.

We keep records for as long as required by law, including the record keeping requirements of conveyancing legislation in each state and the Model Participation Rules, which require us to retain verification of identity evidence. When we no longer need personal information and are not required to keep it, we take reasonable steps to destroy or de-identify it.

11. How can you access or correct your information?

You can ask for access to the personal information we hold about you, or ask us to correct it, by contacting us using the details below. We will need to verify your identity before releasing information. We will respond within a reasonable time. If we refuse a request, we will tell you why in writing, unless it would be unreasonable to do so, and explain how you can complain.

12. How do you make a privacy complaint?

Contact us first, in writing, with the details of your concern. We will investigate and respond within a reasonable time.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.

13. Changes to this policy

We may update this policy to reflect changes in the law, our services or our website. The current version is always published on this page, with the date it was last updated.
